§ 22-63. Penalties.

  • The following penalties shall be in force governing violations of certain provisions of this article.

    (1)

    Any person found on the waters of Sibley Lake without a special recreational license (either a valid annual license or a valid permanent license), shall be guilty of a misdemeanor. Said person shall be subject to a fine of five dollars ($5.00) for the first offense and ten dollars ($10.00) for each offense thereafter. In default of the payment of the fine, the person so found guilty shall be subject to five (5) days in jail.

    (2)

    Whoever violates section 22-56(2) of this article relative to the use of seines, fish traps and nets in Sibley Lake shall, for each offense, be fined not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) and in addition, at the discretion of the court, may be imprisoned for not less than sixty (60) days nor more than one hundred eighty (180) days, without suspension thereof.

    (3)

    The violation of any of the provisions of this article, other than those described in subparagraphs (1) and (2) of this section, shall constitute a misdemeanor. Any person found guilty of a violation of any of the provisions of this article except those specified in subparagraphs (1) and (2) of this section shall be fined fifteen dollars ($15.00) for the first offense and not to exceed one hundred dollars ($100.00) for each offense thereafter. In default of payment of such fine any person so found guilty shall be subject to a jail sentence not to exceed ten (10) days.
