§ 19-112. Definitions.

  • The following words, terms, and phrases, when used in this article, shall have the meaning described to them below, except where the context clearly indicates a different meaning:

    Auxiliary group, except as otherwise provided in this article, means a group which is associated with a nonprofit veterans association, which functions in a subsidiary capacity to the parent organization and exists for the benefit and enhancement of the parent organization, shall be considered part of the parent organization for purposes of this article.

    Bingo means the game of chance commonly known as bingo played for prizes with cards bearing numbers or other designations, five (5) or more in one (1) line, the holder covering numbers, as objects similarly numbered are drawn from a receptacle and the game being won by a person who covers a previously designated arrangement of numbers on such a card.

    Charitable organization means a nonprofit board, association, corporation, or other organization domiciled in this state and qualified within the U.S. Internal Revenue Service for an exemption from federal income tax under Section 501(c)(3), (4), (5), (6), (7), (8), (10) or (19) of the Internal Revenue Code.

    Commercial lessor means any person or entity other than a bona fide nonprofit organization licensed under this article who leases any building, structure, or premises to organizations licensed under the provisions of this article.

    Distributor means any person or other entity who sells, offers for sale, or otherwise furnishes to any person supplies or equipment for use in the conduct of any game of chance authorized under this article.

    Electronic video bingo means a machine designed for the specific purpose of playing the game of bingo as described above except that an electronic random number generator may be utilized to select numbers in lieu of the drawing of numbers from a receptacle and that one (1) or more video images containing numbers or other designations five (5) or more in one (1) line may be utilized instead of a card.

    Electronic video bingo machines means electronic or video machines for the playing of electronic video bingo.

    Manufacturer means any person or other entity who manufactures for sale, offers for sale, or otherwise furnishes any gaming supplies or equipment for use in the conduct of any game of chance authorized under this article.

    Net win means the sum obtained by subtracting total coins in minus the total amount paid out on ticket vouchers for cash money.

    Licensee means any person or entity that has been issued all licenses from the office of charitable gaming and the city business license department that are required under this article or state law.

    Office of charitable gaming means the office of charitable gaming within the Louisiana Department of Revenue.

    Pull-tabs means single or banded tickets or cards each with its face covered to conceal one (1) or more numbers or symbols, where one (1) or more cards or tickets in each set have been designated in advance as a winner.

    Qualified EVB charitable organization means a nonprofit board, association, corporation, or other organization that:

    (1)

    Is domiciled in this state;

    (2)

    Is qualified within the U.S. Internal Revenue Service for an exemption from federal income tax under Section 501(c)(3) of the Internal Revenue Code;

    (3)

    Holds the majority of its organization meetings within the city;

    (4)

    Performs the majority of its charitable work within the city; and

    (5)

    Spends the majority of its charitable funds within the city.

    Session represents authorized games of chance played within a time limit of six (6) consecutive hours, with a minimum of twelve (12) hours between sessions. A session of keno or bingo, when the licensee possesses a special license, is limited to six (6) consecutive hours. Sessions are limited to not more than one (1) session per day per licensee.

    State law means all State of Louisiana statutes, regulations, and other requirements applicable to the games of chance authorized under this article, including but not limited to those set out in Louisiana Revised Statute Title 4, Chapter II and Louisiana Administrative Code Title 42, Part I, Subpart 1, Chapters 17 through 22.
